Terms & Conditions

I have the authority to order and authorize the above work and do so order as outlined above. It is agreed that the seller will retain title to any equipment or material furnished until final and complete payment is made, and if the settlement is not made as agreed, the seller shall have the right to remove same, and the seller will be held harmless for any damages resulting from the removal thereof. Payment is due upon completion of work. If payment is not received as stated, a monthly compounding 1.5% surcharge will apply as well as any and all charges associated with collecting payment. The above-ordered work has been completed, and I acknowledge receipt of my copy. Any quoted price is valid for 30 days. If payment is not made as agreed I understand and agree to be financially responsible for all costs including all collection costs, attorney’s fees and court costs. I understand that financing is not offered directly through His Plumber and that once all work has been completed payment is due in full. Any unpaid balance shall be subject to the monthly compounding surcharge and once past 30 days it will be handed over to an attorney to handle collection. All costs associated with the recovery of the original balance plus interest plus collection costs shall be added to the final balance.

Parts Warranty

All parts recorded are warranted as per manufacturer specs. Two or Three Year Warranty: Two or Three Year Warranty is only valid on recommended repairs when applicable and is subject to the terms and conditions available here.

Labor Guarantee

The labor charge as recorded here relative to the equipment serviced as noted, is guaranteed for 90 days commercial or one year residential. We do not guarantee parts other than those we supply. If repairs later become necessary due to other defective parts, they will be charged separately. All expressed warranties void if improper care or neglect is present or due to acts of nature including, but not limited to, freezing, flooding, lightning or power surges.

Sewer Cleaning

In cleaning or snaking sewer drains which are broken or separated, there is an increased risk that the cables from the sewer machine equipment and camera scope line may become lodged in the sewer drain. Should this occur, the property owner will incur any and all costs for removing the cables from the sewer drain. The cables will need to be removed promptly to avoid further damage to the sewer pipes located on the owner’s property or those on the county side of the sewer line. the owner would be responsible for the cost of lost or damaged cables along with all associated costs in excavation and retrieval. We do not guarantee any sewer cleaning as all cleaning is known as “an attempt to clear the line”. We shall take all reasonable effort and make use of all equipment which we have including use of cables, flex shaft, camera and locator in order to identify the obstruction and clear the line. Due to unknown variables such as usage patterns of the owner, septic conditions, city sewer tap, sewer lateral conditions, backfall of pipe, settling of pipe, cracks, root intrusion or other such conditions whether visible or present on the day we arrive or not all can lead to a secondary back up. If we find a direct reason for a backup we shall state this on our work order and make any recommendations for additional repairs along with pricing.

Damages

Whether during the course of our work or there after we are not responsible for damage to personal property to include but not be limited to, attic insulation, ceilings, ceiling textures, walls, floor coverings, equipment, cabinets, counter tops, fixtures, appliances, paint or stain, nor for the repair of any cosmetic defects. We do not repair or replace wallpaper, other wall coverings or floor coverings.

Water Heater Disclaimer

Customer has been advised that the water heater should remain set at 120 degrees as determined by the manufacturer and Gas Appliance Manufacturers Association (GAMA) standards. See our full warranty disclosure on this website under the “Warranties” page.

Hazardous or Obsolete Materials

We will not perform repairs involving hazardous or toxic materials. We will not perform repairs on any equipment, systems, parts, etc. which we determine to be obsolete.

Recalled Piping

Polybutylene (PB) pipe and Nibco piping both have been recalled and have class action suits. We cannot guarantee any connection made to either of these pipes, nor can we warranty any repair made. We cannot guarantee any connection made to other piping which has either a manufacturer recall or has ongoing litigation. Customer understands and agrees that should another repair become necessary after making a repair then such additional repair will charged in addition to the first repair and if any water related damages occur to such piping or the process of working on such piping these damages shall be excluded from our warranty and are the homeowner’s liability.

Mold Waiver & Release of Liability

In consideration for the plumbing (“Services”) to be performed by His Plumber Inc. (the “Company”), Customer acknowledges that the Services may have risk of mold and Customer expressly agrees to assume the risk of all damages and injury to property or persons, if any, resulting from any and all mold related damages. (Mold related damages shall include, but not be limited to, damages related to mold, fungus, rust, corrosion or other bacteria or organisms). Customer hereby releases the Company and its agents, owners, and employees from all claims, losses, damages, risks, or causes of action, whether no known or unknown, arising now or in the future and arising directly or indirectly, from the services which result in damages caused by mold or mold related issues. This release includes claims related to the property damage, personal injury, loss of income, emotional distress, death, loss of use, loss of value, and adverse health effects, or any other effects.

The Company will not be responsible for the identification or notification of existing or future mold spores arising out of the past, present, or future plumbing conditions. Similarly, the Company will not be responsible for the cleaning, repair, removal, replacement, remediation, or abatement of affected structures or surfaces. The customer acknowledges that the Company has not made any representations regarding the extent or potential of mold which may or could result from the Services, nor the consequences of mold which may o could arise, and the conditions which may result in mold. This Agreement is to assure the Company that it can undertake the Services without liability for any known or unknown condition which may result in mold. customer agrees not to bring any action, whether by litigation. the Customer acknowledges that this agreement includes work performed by the Company to complete the Services and results of the Services, both now and in the future. the Customer acknowledges and represents that he/she is legally authorized to enter into this Agreement, that Customer has read this agreement fully and understands the terms and conditions of it, that Customer is of legal age and legally competent to execute this Agreement and has done so of and has done so in consideration of the Services rendered by the Company. This Agreement shall be binding upon and ensure to the benefit of the Company and the Customer and their respective heirs, executors, administrators, legal representatives and assigns.

Waiver

In completing repairs, Customer recognizes that there is a risk of damage to persons or property. Customer recognizes that His Plumber Inc. liability shall be limited to furnishing labor and parts necessary to remedy any defects in parts or workmanship which are covered by our Warranty. We are not responsible for personal injury or for any indirect, incidental or consequential damages to persons or property.

In addition, we offer no warranty on plumbing connections to Polybutylene or Nibco systems. All connections or repairs to this plumbing system are considered temporary until a full pipe replacement can be arranged. We will not be in any way responsible for damages which are the result of on any leak from any part of the Polybutylene or Nibco system, to this property or adjoining properties.
